Sorry there hasn’t been a new message lately. I am working on a Jesus is Better than the Law Thing from John 5. I’m just really slow. In other news, I’m hoping Another Book: Jesus in John’s Apocalypse(I think that is the official title) will be out soon. The text is pretty final and it has been approved by a really great publisher, I have to work out some financial issues to get the ball rolling, and then I hope to have some good news on that front. I am opening up Ch.2 Left Behind? Just don't call me late for dinner. For free subscribers, so enjoy. I am pretty proud of it. So pray for us.
For the fourth installment in our look at how the Constitution might be used to fix our out of control Federal Government we are going to look at Reforming Taxation and holding individuals in the government accountable by Removing Qualified Immunity and Investing Officers of the Government with a Fiduciary Duty. Please check out the Intro to MASA(Make America Small Again) and the previous Amendment Polls: Term Limits and Ban on Undeclared Hostilities and Clandestine Activity, Pushback the Federal Landgrab and a Day of Rest, and The End of Birthright Citizenship and An Amended Tenth Amendment, and PLEASE the idea here is not for me to say what to do but to crowdsource some wisdom to see how different ideas might go right or go wrong, so comment. I have also added polls to the previous posts to try and gauge how crazy I am. They are open for a week. I’d love to know why you think what you think. Anyway, the new Amendment Proposals:
I think people of all types will agree that Federal officials do not bear enough responsibility for their actions. One reason is because ‘qualified immunity’ makes it excessively difficult to hold them accountable for official actions. My proposal is that all employees of the government should be considered to have a ‘fiduciary duty’ to the citizens, like the duty that an attorney has to their client, an agent has to their employer, or a trustee to the beneficiary. This is usually considered to involve duties to:
Care-to inform oneself in order to make good judgments for the citizens
Loyalty-puts wellbeing of the citizens first and foremost, recuse themselves when there is a conflict of interest
Good Faith-always advance interests of the citizens within the law, never act contrary to interests of the citizens
Confidentiality-cannot use citizens’ information or government information for their own purposes or gain
Prudence-must make decisions with high degree of skill, caution, and awareness of risk
Disclose-must disclose any and all relevant information that could impact client
A breach of fiduciary duty by a government official or employee should require removal from service, ineligibility for any government position, civil and criminal liability. Government officials should be held to this standard. Warrantless searches or attempts to get around constitutional rights must have consequences. Concealing documents that the people have a right to must lead to termination. Generals who care more for defense contractors than the good of the country or who are simply incompetent commanders must be court martialed. Agency heads who make deals with the companies that they regulate must be removed. Congressmen who legislate for the benefit of their stock portfolio or make laws that violate the Constitution must be removed. Vice-presidents who administer a trust for their son’s benefit cannot be elected to subsequent offices. I understand the fear of police officers not arresting criminals because they are afraid of getting sued, it’s real but all day every day the government acts as an unaccountable aristocracy and we can’t afford to tote them any more. Government agents have no incentive to provide us with good service and no disincentive against providing us with bad service. If this is really a government of the people, by the people, and for the people, then it’s time to start acting like it.
